I responsabili dei massacri di Porto Edda e Kuç

Le stragi di Porto Edda e di Kuç furono eseguite dagli uomini della I Divisione da Montagna "Edelweiss" (Stella Alpina), già responsabile dell'eccidio dei nostri soldati a Cefalonia e Corfù.Vale la pena ricordare che la "Edelweiss" faceva parte dall'esercito regolare tedesco (Heer - Wehrmacht).
Di seguito lo stralcio della sentenza di condanna per crimini di guerra:
"The defendant Lanz is also charged as commander of the XXII Mountain Corps with having ordered or permitted the unlawful execution of Italian officers and soldiers of the surrendered Italian army.
.....
A similar situation developed on the island of Corfu. Fighting ensued, the Italians surrendered, and the officers shot after a summary court martial. The record shows that a large number of Italian officers were shot in this manner. One instance shows that on 5 October 1943, 58 Italian officers were shot by troops subordinate to the XXII Corps.
The killing of these Italian officers was clearly unlawful. The evidence of the defendant shows that he believed that their killing was unlawful. While his protests to Army Group E, based on the illegality of the Fuehrer order, were successful in reducing the number of Italians to be subjected to the unlawful order, the fact remains that the killing of the reduced number was just as much a criminal act. That he gave the order to the commandant of Cephalonia to execute the guilty officers only, he readily admits. The Italian soldiers were not francs-tireurs. They were still allies of Germany, insofar as their commanding officers then knew, although they had notice that an armistice had been signed with the Allied Powers. If they were prisoners of war by virtue of the surrender of the 11th Italian Army by General Vecchiarelli, it is clear that they were entitled to the protection of the Geneva Convention, 1929, regulating the treatment to be afforded prisoners of war. This was not done in any material respect. The reasoning set forth on the same subject in this opinion as it pertains to the defendant Rendulic applies here and is adopted by reference to the present situation. We are obliged to hold that the killing of the Italian officers was a war crime for which the defendant is responsible.
"L'imputato Lanz è anche accusato come comandante del XXII Corpo d'armata di montagna di aver ordinato o consentito l'esecuzione illecita di ufficiali e soldati dell'esercito italiano che si era arreso.

Una situazione analoga si è sviluppata sull'isola di Corfù. Combattere ne seguì, gli italiani si arresero, e gli ufficiali furono fucilati dopo una sommaria corte marziale. La storia mostra che un gran numero di ufficiali italiani sono stati uccisi in questa modo. Una prova evidenzia che il 5 ottobre 1943, 58 ufficiali italiani sono stati uccisi dalle truppe subordinato al Corpo XXII.
L'uccisione di questi ufficiali italiani era chiaramente illegittima. Le prove addotte dall'imputato dimostrano che egli credeva che la loro uccisione era illegale. Mentre le sue proteste al Gruppo d'armate E, sulla base della illegittimità del provvedimento Fùhrer, hanno avuto successo nel ridurre il numero di italiani a subire l'ordine illegittimo, resta il fatto che l'uccisione del numero ridotto è stato altrettanto un atto criminale. Per sua stessa ammissione, ha dato l'ordine al comandante di Cefalonia di fucilare solo gli ufficiali colpevoli. I soldati italiani non erano franchi tiratori. Erano ancora alleati della Germania, almeno nella misura in cui i loro comandanti sapevano, anche se era noto che l'armistizio era stato firmato con le Potenze alleate. Se fossero prigionieri di guerra in virtù della resa dell'esercito italianoda parte del generale Vecchiarelli, è chiaro che essi avevano diritto alla protezione della Convenzione di Ginevra del 1929, che disciplina il trattamento di cui devono beneficiare di prigionieri di guerra. Questo non è stato fatto in nessuno dei suoi elementi fondamentali. Il ragionamento già fatto sullo stesso argomento nel presente parere, per l'imputato Rendulic, si deve applicare anche in questo caso. Siamo obbligati a ritenere che l'uccisione degli ufficiali italiani è stato un crimine di guerra per cui l'imputato è responsabile."
